State v. K.M.

Challenging the Statute of Limitations

06/01/2023

Attorney Dimmer successfully corners State with Statute of Limitations

Attorney Dimmer took on a very serious sexual assault of a child case in Kenosha. The allegations dated back to the late-1980’s, when the complainant was only 4-5 years old and the defendant was only 16-17 years old.

The primary question was whether the alleged conduct could have occurred before or after the Statute of Limitations changed in Wisconsin for child sexual assault crimes.

With early motion filings and thorough investigation, the State’s witness could not show or testify that the alleged acts could have occurred after the statute of limitations. Hence, the State moved to dismiss its case mere days before trial.

Great work, Attorney Dimmer!
